Timothy P. O’Connor recently obtained a substantial reduction by the United States Court of Appeals for the Seventh Circuit of portions of the restitution and forfeiture ordered by a district court as part of a sentence for multiple convictions for wire and mail fraud. The government conceded in its appellate brief that the district court had erred in including these amounts, which totaled approximately $230,000.00, within the restitution and forfeiture portion of the sentence, and the Seventh Circuit accepted these concessions and modified the judgment below accordingly.
In the remainder of its opinion, the Seventh Circuit declined to overturn the convictions below and left standing the remainder of the restitution and forfeiture portions of the judgment, which totaled slightly over $102,000.00.
